Warning Problems of BMW X5

I have recently experienced sudden phantom braking on my vehicle on three separate occasions, following a recall on a brake module that was taken care of at the dealer. Each time this happened at highway speed for no apparent reason. The dealer, BMW of buffalo has had the car for over a week without finding the problem. They have been in constant touch with corporate, trying to diagnose this. No luck! I will not drive this vehicle, nor can I in good conscie nce trade it in to another dealer. I could be held liable. I'm wondering what you may have on record since there are reports on the web of similiar occurances.

The issue involves water intrusion through the shark fin antenna, which has caused significant electrical malfunctions in my vehicle. Description of the problem water appears to be leaking into the vehicle through the shark fin antenna located on the roof. This has resulted 1. Failure of the infotainment system (screen not functioning). 2. Inability to start the car (starter not activating). 3. Turn signals operating without the typical cabin clicking sound. This issue has left the vehicle inoperable on multiple occasions and poses a safety risk, as critical systems such as the emergency call function and vehicle ignition are affected. Impact on safety •a malfunctioning starter prevents the vehicle from being driven, potentially leaving me stranded in unsafe locations. •turn signal failures reduce the audible warning, increasing the risk of accidents. •water-damaged electrical components could lead to further issues, such as shorts or fires. Research and observations after researching, I found that other BMW owners have reported similar issues involving water intrusion through the shark fin antenna, leading to widespread electrical problems. This suggests a potential design or manufacturing defect. Request for action I respectfully request that the NHTSA investigate this issue to determine whether it constitutes a safety defect requiring a recall or service bulletin from BMW. The car model I have includes an additional fee for a "drivers" assistance package; this feature doesn't work as designed. BMW likes to call it 'limitations of the system', but will not offer any repair, correction or refund for this "issue". Unfortunately, this issue is such a hazard and pops up so spontaneously, if there were any cars around I would have collided with them. BMW says this is called "greying". The systems doesn't recognize or sense the terrain and attempts to warn the driver, but the car will veer on it's own into the second lane or try to cruise into the median. I have this incident on video. It will also not slow to stop when exciting the highway offramp; there have been many times where it has actually dangerously accelerated. I will attach the slip from the dealership, which I have been to 3 times, with no solution. I have communication with the dealership stating that they agree it's a hazard, but don't know how to fix it due to the "limitations of the actual system". Asking for the feature to be removed and get my money back is apparently not something BMW is interested in doing. They would rather keep unsafe and unpredictable vehicles on the road in the name of profit. I am deeply concerned that there are other models like mine on the road that will cause a fatal accident.

I was driving in the left lane of the freeway, and there was a k-rail to the left of the lane, because there was construction in the shoulder. At one point, there was a break in the k-rail, where it had an opening, and went away from the lane, then back about 20 ft later. The lane departure system jerked the wheel to the left, attempting to steer out of the lane; if I had not held the wheel steady, it would have steered the vehicle directly into the k-rail as it rejoined the side of the lane.
