The contact owns a 2011 infinti Ex35. The contact stated that the brake and accelerator pedals were positioned very close to one another. The contact also stated that the pedals were positioned at the same height levels. The contact attempted to brake on several occasions and accidentally depressed the accelerator pedal as well. The manufacturer was made aware of the failure and stated that there were no remedies for the failure. The failure mileage was unknown and the current mileage was 17,000. The VIN was not available.
