1 Warning Light On problem of the 2009 Infiniti EX35

I took the car to jim coleman Infiniti service department to find out why the air bag warning light is flashing non-stop. After the diagnostic they concluded it was due to passenger side OCS sensor faulty, so in order to replace the sensor they need to replace the entire passenger seat due to sensor embedded in the seat and asking for around $4500 for parts and $600 for labor. It's outrageous! although I bought the car at 2009 I hardly drive the car and took metro to work most of the time so the mileage is only <50k. After I did a research on the web I discovered that the 2007, 2008 Infiniti Ex35 model all have the same exact problem that resulted a recall. Per NHTSA, a sensor located in the passenger seat cushion "may have been manufactured out of specification. Under certain conditions, this could cause an interruption of signal between the OCS [the occupant classification system -- which activates the airbag when the passenger seat is occupied] and the airbag control unit. This could result in the passenger airbag being suppressed, which could fail to provide adequate protection in the event of a crash. " it appears that Infiniti did not fix the problem for the 2009 model which was probably already on the sales lot and as long as there's no warning light flashing they assume no sensor problem but the underlying sensor defect still exist and waiting to erupt. I should not have to pay for Infiniti's obvious design/manufactured sensor defect especially it is the well-known sensor defect that cause their 2008 recall (https://cars. Usnews. Please advise what I can do to make Infiniti to be responsible for fixing the same defect from the 2008 recall at no charge to the customer deceived by them? thank you very much.

2 Warning Light On problem of the 2008 Infiniti EX35

The dash board airbag warning light started flashing. It stayed flashing for a few weeks, so I took it to an Infiniti dealership. The dealership told me there was some type of communication problem between the acu and OCS units, located under the passenger seat. They said they couldn't tell any more than that, and would try replacing the acu first (this cost me over $1000). They then said if the flashing light came back, the next step would cost me over $3200 (replacing the OCS, I guess). I then looked online for others with this problem, as this part is inside the car, and wasn't damaged in any way (I have the old part, looks in perfect condition), so I was suspicious that this was a manufacturer's defect. To my surprise, when I searched for 2008 Infiniti Ex35, I found not one, but *three* recalls for passenger seat acu/OCS problems! when I asked the dealership why my repairs weren't covered under one of those recalls, they insisted there were * recalls for my VIN. Thus started my education about "VIN specific recalls". So naturally, I asked why my VIN wasn't included in any of these recalls - they answered "we don't know. " so, I asked, "who knows?" they then directed me to you (the NHTSA), which puzzled me, as I expected it was Nissan itself which decides what VIN's are covered and which are not - the Nissan representatives I spoke to insisted this wasn't the case. So, my complaint my VIN should be covered by (one of) these recalls. I find it extremely unlikely that my acu failed because of "wear and tear". I believe there is a common problem(s) underlying these recalls, which also affected my car. A manufacturer's problem.
