I purchased a 2003 Mercedes Benz e320 custom ordered. There are erratic, inconsistent,intermittent problems of defective brake operation, radio,cd,seat controls,instrumentation,windows control,tire pressure indication, restraint system,transmission operation, srs system. These problems occur randomly. Twice,when I needed to brake quickly the brakes did not stop the car. The brake assist feature did not work. The car's brakes are terrible and unreliable, and constitute safety danger on the road. There are numerous malfunctions reported by car indicated on the instrument panel. All or most of these problems are electrical system problems associated with the gateway module*software*. The can-bus system on car,which also controls brakes,does not have correctly-operations of ware,and it affects most electrical and mechanical system functions in the car. There are data collisions and packet conflicts on the bus because the software is not written correctly or the computer system and software is overloaded. Reading over the 55 2003 e320 complaints on your website,it is clear that most of them are due to this software problem. The car has been brought back to the selling dealer ,Mercedes Benz of san diego,*over 50 times*during the years 2003-2007 with no solution. The car warranty is set to expire in a week, and these problems are not yet fixed. The nhtsb demand Mercedes Benz either redesign the system or rewrite the software and test it for about 40,000 hours, or replace the vehicles with post-2003 e-class models, free of charge the nhtsb has been duped by Mercedes Benz into believing that replacing hardware components solve these problems the nhtsb should test the network software by examining data flows and function calls during the operation of the electrical and mechanical system features of an e320 and diagnose for data collisions and packet conflicts during automobile feature operation.

This car has a significant safety related design defect. The car jerked to a sudden stop after water was spilled from the cup holder onto the shift console. I was luckily driving at a slow speed(less than 25 mph). The car suddenly jerked. I pulled over and couldn't shift the car out of gear. I had to turn the car off, and then I could get to neutral (luckily on a flat street or the car would have rolled away from me). After turning the car on and off I got the gear shift into park. I had the car towed to the mercedes dealer, who told me this happens a lot and that it would probably be $800 to replace the electronics that had shorted out. I believe this is a significant design flaw to have a cup holder next to an area prone to shorting out with water exposure. This was a very small amount of water. Also I'm very concerned about driving the car on the highway. . If this had happened at high speed, I'm fearful I would have lost control of the car. Vehicle automatically shifted into lowest gear while driving, causing a dangerous condition, slowing the vehicle substantially in traffic. Vehicle refused to shift into higher gear or reverse. Towed to the dealership, who replaced shifter mechanism due to electronic failure, caused by spills. Observation of the part showed no residue from any liquid. Dealership said it happened all the time because the cup holder was right above the circuit board in the console and it was not sealed. Stated the replacement part installed was improved to prevent this from happening again.
While driving in snowy weather and climbing a hill, the electrical traction control system took over and the vehicle accelerated resulting on loss of control of the vehicle and hitting a boulder off the highway. Prior to loss of control, the electronic trouble code light illuminated.

When water enters the control module for automatic transmission it fails to change gears while vehicle is in operation. Dealership has not given consumer a cause for this problem. Please provide any additional information/attachments.
