The car was off and parked, I had been driving, and my grand daughter in the back seat. My grand daughter who is [xxx] old was getting out of the car from the passengers rear door and the rear seat belt locked and retracted around her , continuously tightened and was wrapped around her abdomen, squeezing and failed to release. I attempted myself to get her out of the entrapment with no success. I ran into the building for help, four adults who were trained in child safety, devices attempted to activate the manual release mechanism described in the manual, but the belt remained completely jammed and trapped her, she was screaming in pain and due to the immediate physical trauma and emergency, we were forced to cut the seat belt to free my grandchild. Nissan consumer affairs was notified under reference # xxx, but they have closed the file, refused to cover the repair, and explicitly refused to provide me with a copy of their investigation report. The seat belt retractor represents a severe safety hazard. I have called them and they state, case closed and no, we won’t be releasing the report. The contact owns a 2020 Nissan Kicks. The contact stated that while driving at various speeds, the front driver's side seat belt independently unlatched. The local dealer was not contacted. The vehicle was not diagnosed or repaired. The manufacturer was not made aware of the failure. The failure mileage was approximately 197. The VIN was not available.
On June 16, 2022 I suffered a medical emergency and the vehicle drifted out of the lane into the guardrail to the right. No lane departure warning sounded or alerted me. The vehicle grazed the guardrail on the passenger side then veered left across the other 3 lanes with no warnings or alerts sounding. The seatbelt did not lock up during the guardrail incident or upon impact of the vehicle into a hillside where the vehicle eventually came to a stop. When I fully came to, I saw the gearshift broken off and I had a broken nose. Several other items from the dash were also broken off from my face hitting them. I suffered multiple injuries, one of which required surgery. I have a door panel shaped hematoma on my left hip, however all the medical records state "restrained driver" and can be provided upon request along with any other reports. The vehicle is currently at monroe's collision center awaiting a determination on the extent of the damage. Several, if not all, airbags deployed. I had my car for 17 days. The windows are currently down and the vehicle will not start.
