Front Driver Side Air Bag Inflator Problems of BMW 323

Takata recall driving around 25 mph car hit a pothole going straight on a city street. Side passenger airbag deployed hitting my cousin just as described in this recall 02v223000. The car is also affected by the takata inflators airbag recall which thankfully didn't deploy at the time of hitting the pothole. BMW does not want to take responsibility for the deployed air bags because, according to them, the car's VIN number was not affected by side air bag deployment, even though year and model matches the effected vehicle. They are, however, willing to repair the takata airbag.
