Transmission Noise Problems of BMW 323

I am the original owner of 2000 BMW 323i with 109k miles. One fine day the reverse gear on the car just stopped working without any warning or noise. I took the car to the BMW dealership who did the diagnostic and told me there's a transmission failure and that the new transmission will cost $5,880. I then went online and found a site "noreverse. Org" and was shocked to see numerous BMW owners reporting the same issue. I called BMW customer relations and they refused to offer any assistance nor did they own up to the problem, stating that it's out of warranty. Given the number of complaints received by NHTSA (175 as of September 5th, 2010 for "2000 323i" under the category of "power train automatic transmission") and a huge number of complaints listed on "noreverse. Org" and other consumer sites, BMW ought to have done a recall of these defective transmissions (zf5hp19) and set an example for a responsible global brand they stand for.

2 Transmission Noise problem of the 2000 BMW 323

I have an issue with my 2000 BMW 323i sedan e46, on multiple occasions the reverse all of a sudden goes out, no noise, no warning, it just doesn't clutch reverse in the clutch box. Luckily I've been only in a park idol position. I would have to push my car to back out and it's really frustrating. And from researching, my BMW 323i transmission is made by gm, who which did a recall on there transmissions and so did Cadillac because they have used the same transmissions as BMW 323i. I'm surprised BMW USA hasn't done a safety recall yet. I want to get this fix, but BMW can only swap a transmission which cost $5500.
