The contact owns a 2007 BMW 530i. The contact stated that while driving approximately 10 mph and depressing the brakes, the vehicle suddenly accelerated forward without warning. The contact stated that the brakes failed to respond and as a result, the contact crashed into a building. The contact was taken to the hospital for treatment of injuries to the ribs and muscle tearing. A police report was filed. The manufacturer was notified of the failure. The vehicle was destroyed. The approximate failure and current mileage was 148,000. The VIN was not available.

After turning into a parking lot, I slowly turned right onto a two-way driveway without lane markers. To my right was a curb. To my left was opposing traffic. Moving very slowly while waiting for the opposing traffic to pass so I could select a parking space, I turned my steering wheel a bit to the right in order to maneuver around a large vehicle to my left, and then a bit to the left in anticipation of parking on the other side of the opposing traffic. I felt a bump on the right side of the car, and damage there suggests that the body momentarily rested on the curb and that the tire was not in contact with the ground. At this point, although I did not move any controls, the vehicle accelerated rapidly, surging forward and to the left:
•I heard the engine revving very loudly, with more power than I had ever heard in nearly seven years of experience with this vehicle. €¢I felt a very bumpy ride, as if the vehicle was driving down a flight of stairs. €¢with the car accelerating at a tremendous rate, I saw the parked cars getting close incredibly quickly. There was no time to react. I never had a chance to use the brakes. In a distance of 23 paces, the car went from barely moving to slamming into a parked car with enough force to push that car sideways into a second parked car and to push the second parked car sideways into a third parked car. Two parked cars were totaled. It was only by chance that nobody was between the cars that were hit. My airbags deployed. I asked BMW to conduct an investigation. They said there was nothing wrong with my car except the floor mats. I asked BMW about NHTSA incidents: 10102759, 10357973, 10344193, and 10323285. Bmw’s response was that the government has never asked them to investigate those incidents. There is a documented history of warning messages from my dsc/dtc system. BMW admitted in writing that there are cases in which this system can cause the wheels to accelerate, but insisted that it’s "impossible" to accelerate so much.

Information redacted pursuant to the freedom of information act (foia), 5 u. S. C. 552(b)(6) I ([xxx]) am filing a complaint on behalf of my mom ([xxx]) who owns the 2007 BMW 530i in question (VIN #: [xxx]). English is not her primary language. According to my moms account, on 11/10/2009 she pulled her car into the driveway and waited for the garage door to open. But as she let go of the brake pedal, the car started to accelerate very quickly without her intention. She tried to apply the brakes, but the cars motor was just too powerful to prevent the car from continuing to accelerate into and almost through the garage wall. We reported to BMW of north America and asked them at the time weather unintentional acceleration and or some problem with the electronics governing the cars accelerator was responsible for the accident and they took the vehicle, tested it, and concluded that the vehicles diagnosis returned no such error. I explained to them that with drive by wire technology and all the electronics governing the car, there could have been some soft of a short-circuiting or problems with it. They told us that there was nothing they could find wrong with the vehicle. We were told that it was my moms fault and that she might have mistakenly pushed the wrong pedal, which my mom vividly remembers she did not because once the car accelerated she quickly try to push the brakes, which were overpowered by the car. The contact owns a 2002 BMW 530i. The contact stated while reversing out of a parking space at 5 mph, the vehicle rapidly accelerated crashing into another vehicle causing damage to the rear and front of the vehicle. No one was injured during the crash. After the crash the contact returned the vehicle to the dealer. The failure mileage was 93,000.

While driving in a parking lot at approx. 3-5 mph, my 2005 530i suddenly accelerated while my foot was on the brake. I pushed on the brake pedal as hard as possible to slow the vehicle, then quickly shifted the automatic transmission into park and turned off the key. I took the car to the BMW dealer where I bought the car. They were unable to find the problem, so they have brought in engineers from BMW north America to analyze and fix the problem.

While backing out of the driveway, the vehicle unexpectedly accelerated. As the consumer backed out of the driveway with her foot on the brake, the vehicle lost control accelerated backwards into the street. The consumer pressed harder on the brake to stop the acceleration but it did not respond. The incident happened a second time. The dealer was unable to duplicate the problem.
