Cruise Control problem #1

The contact owns a 2009 Dodge Caravan. The contact was driving with the cruise control set at 60 mph. The contact attempted to pass another vehicle when the vehicle abnormally accelerated with an unusually high increase in rpms. The vehicle was merged to the side of the road and the engine was turned off. Contact was able to restart the vehicle with and drive as normal. The contact stated that the failure recurred continuously for approximately two days. The manufacturer was not notified of the failure. The contact was awaiting diagnosis of the failure. The failure mileage was 75,000.

Vehicle Speed Control problem #2

On several occasions the van has shut off when driving. I have to go to the side of the road to a complete stop and then restart the van. I have had it in to several mechanics to try to find out what the issue is and have been told to bring it in when it happens again, which always seems to be when I am on the highway or after hours. I received a recall notice for this issue (l25/NHTSA 14v-373) and have called the dealer several times and was told the part was not available and they would call me as soon as it became available. The last time I called I was told they no longer are making the part of this year vehicle. My question is, that if I have an accident and am injured or killed because this issue has been unresolved who should I let my family know to contact, for damages? I don't feel we should be forced to buy a different vehicle just because the corporation has failed to make sure this vehicle is safe. Please advise.
