The contact owns a 2008 Hyundai Veracruz. The contact took the vehicle to the dealer on two different occasions for the same failure. She believed that the accelerator pedal was stuck and caused unwanted acceleration. The contact also believed that the vehicle was not shifting properly. Occasionally, the vehicle would get caught at a certain speed, and would not accelerate at the appropriate time. The engine would not rev, but continued to hesitate. The first time the vehicle was taken to the dealer, they stated that they could not find any failures with the vehicle. Two months later, she brought the vehicle back to the dealer because she smelled gasoline in the vehicle; however, there were no signs of a leakage. The dealer was unable to find any failures with the vehicle for the second time. On July 3, 2008, while parking the vehicle at 2 mph, the contact shifted into reverse and began to back up. Suddenly, the vehicle jumped into gear, surged forward, and crashed into two parked vehicles. She attempted to engage the brakes, but they failed. The crash damaged all three vehicles involved, as well as the landscaping. A police report was filed. The vehicle was towed to her residence, where it is currently located. The failure mileage was 2,500 and current mileage was 8,819.
