Timing Tensioner Problems of Jaguar XK8

Why hasn't Jaguar been ordered to recall the 1997 through 2002 1/2 models for the timing belt tensioner plastic guide issue? it has been reported here in the past, and is widely known across the internet. I would just like to know why NHTSA hasn't considered this design defect to be eligible for a recall when it is clearly a major safety issue.

Timing chain tensioner failed, broken chain, bent valves. Jag service said '97 Xk8 had faulty tensioners. Most warranty replaced. Many NHTSA complaints & TSB's on this failure. Jag. Is aware of this dangerous problem. Jag. Agreed to pay for 1/2 repair, if I bought a new jag. Not acceptable! does someone have to be killed on the freeway for jag to take notice! there needs to be a recall for this problem! not just service bulletins! both service and sales said that these tensioners will fail! revised tensioners were used on later models!.

After starting the engine, it began to make noise and had a rough idle. The restricted performance message flashed and then the engine died. The timing chain tensioner failed and jumped mechanical timing, which seems to be a very common problem. This could have caused an accident because all power steering and brakes were lost while driving the vehicle through a busy intersection. If you read on any Jaguar forum, this is a problem that is common with the Jaguar 4. 0 v8 from 1998 through 2000.

Jaguar has 40,000 l997 model Xk8 sold for $75,0000. Needs new engine! dealer wont take of expense of replacing it. Web says they have faulty tensioners, and cylinder liners.
