Front Seat Head Restraint problem #1

The front head restraints will not lock in the proper position on my new Lexus Rx350. They keep rising until they reach the top position and they will lock in that position, but not in the first or second positions. This is a safety issue because I need them to lock in the first position. The dealer said they were operating correctly and Lexus said I should get a second opinion from a different dealer. However, the owner's manual on page 71 states: "after adjusting the head restraints, push down on them and make sure they are locked in position. " they will not lock in any position but the top one.

Seats problem #2

My Lexus has a mold problem. They have been unable to remedy it, but will not replace the vehicle. They have tried to remedy the problem no less than 7 times, but cannot eliminate the mold. Employees of Lexus of greenwich have admitted to me that they know this is a recurring problem. Yet they continue to return the vehicle, with mold, to their customers.
