The contact owns a 2009 Mazda cx-9. While driving 65 mph with the sun roof opened and the shade pulled back 3/4 of the way, the sun roof fractured unexpectedly without warning. The vehicle was occupied by the owner, a passenger (wife), and two children under the ages of 8. There were no injuries. The vehicle was taken to the local dealer (open road Mazda of morristown, 108 ridgedale Ave, morristown, NJ 07960) where it was determined that they would not cover the cost of the sun roof. The manufacturer stated that they were aware of the failure; however, there was no recall or failure being investigated. The manufacturer also informed the contact that the vehicle was out of warranty and provided no further assistance. The failure mileage was approximately 125,000.
