The contact owns a 2025 BMW X3. The contact stated that while driving 1 mph in stop and go traffic and approaching another vehicle, the vehicle suddenly accelerated and bucked four times. There were no warning lights illuminated. The local dealer was not contacted. The vehicle was not diagnosed or repaired. The manufacturer was not contacted. The failure mileage was approximately 1,000.

3 Vehicle Speed Control problem of the 2018 BMW X3

Failure Date: 03/06/2025

Around April 2025, while driving at highway speeds for approximately 1hour with cruise control engaged, vehicle suddenly began to decelerate as if I had taken my foot off the throttle. Pressing the throttle had no effect on engine rpm or vehicle speed as the vehicle continued to decelerate. Tapping the brakes then pressing the throttle had no effect as vehicle continued to decelerate. I was able to negotiate across lanes of highway traffic at low speed to reach shoulder with no throttle control. After coming to a stop on the highway shoulder, pressing the throttle failed to rev the engine or move the vehicle forward in drive. After placing transmission in reverse, the vehicle did back up normally allowing me to put the car in a safer position on the shoulder. After turning off the ignition and restarting, the vehicle operated normally. I was able to complete my trip without incident. I did not engage the cruise control. A few days later, I took the vehicle to an BMW dealer service center but no error codes or malfunctions were identified. A second incident similar to the first occurred in August 2025. Again, I was able to reach the shoulder without serious incident. After turning off the ignition and restarting, the vehicle operated normally. I was able to complete my trip. I did not engage the cruise control.

5 Vehicle Speed Control problem of the 2024 BMW X3

Failure Date: 11/06/2024

My vehicle doesn't warn me about rear cross-traffic or it stops for emergency. I paid for this option. Delaer checked the system and reassured me that everything is working. I have to backup to a busy street a few times a day and this system is not protecting me and I am afraid that I will get into a crash. I had several close calls and I am afraid of a crash with this system.

6 Vehicle Speed Control problem of the 2020 BMW X3

Failure Date: 10/03/2024

The accident happened at noon on [xxx] at the amazon fresh/post office parking lot’s far right exit lane facing [xxx] the address is [xxx] . We were leaving the parking lot and I stopped at the exit lane with 2 cars in front of us. After the first car exited, the second car, a black Ford explorer, moved forward. I released the brake slightly but my foot was still on the brake pedal. At this moment, my car suddenly accelerated and quickly approached the explorer. I immediately pressed the brake pedal hard but was unable to stop my car and hit the back of the explorer. The explorer was forced out in front of the stop sign but the driver was able to turn right to park at the roadside. With my foot still firmly on the brake pedal, my car kept on accelerating into [xxx] , crossing 5 lanes of traffic until we hit the roadside curb of westbound [xxx] . The car then swerved left and hit a roadside tree, turning sideways into [xxx] middle turn lane. During this entire time, I did not press the accelerator and the car was violently shaking and jerking right and left. As the car slowed down, I was able to steer the car to the right eastbound lane of [xxx] , next to the parking lot near bank of America’s atm sign. After I got out of the car, I noticed the front and right sides of the body and tires were damaged including crushing, dents, and significant scratching. The problem I believe is as follows: 1. Sudden unintended acceleration and control circuit malfunction. 2. Airbags did not deploy even though we hit a car, curb and tree. 3. Onboard data recorder should have the information needed. Information redacted pursuant to the freedom of information act (foia), 5 u. S. C. 552(b)(6).

7 Vehicle Speed Control problem of the 2021 BMW X3

Failure Date: 08/01/2024

Constant emergency braking when I’m not near another vehicle.

8 Vehicle Speed Control problem of the 2012 BMW X3

Failure Date: 05/01/2024

I emailed BMW of arlington on 5. 13. 2024 detailing the critical safety issue I experienced with my BMW X3 2012 on Sunday, 5. 12. 2024. I was driving on the tollway northbound from i20 in grand prairie in the pouring rain with my wipers on, and the car suddenly started braking and decelerating from the 70 mph cruising speed to 40 mph in seconds. The car behind me nearly hit my vehicle, and since it kept doing that, I had to turn on my hazard lights till I exited. The car was doing that irrespective of whether it was on cruise control or my driving speed. I discovered by googling it that this is a known defect in Bmws since their shop foremen and certified technicians who know more than me think I am dreaming this up—https://w w. Bimmerfest. Com/threads/sudden-momentary-deceleration-braking-at-highway-speeds. 1447635/-. Driving this car on the highways in dallas regularly is extremely dangerous as I could end up in a major multivehicle mva pileup. Also, the previous time I had this issue before I brought it in on may 7, it wasn't raining, and it started with the car not even moving when I put it in reverse and pressed the gas. Then it suddenly started decelerating on the road, backfired, and shook violently at normal speeds. The car overheated as the radiator coolant leaked, and I had to replenish it. Carshield, the auto warranty company, and I paid approximately $7,000 to BMW Mini of arlington between June 2023 and today (see attached invoices_receitps_diagnosis reports). The last two times (10. 21. 2023 and 5. 7. 2024), their multi-point diagnosis on my vehicle identified no issues that need attention. Two of their service advisors who worked on my car in June and October 2023 quit immediately after completing it. The dealership does not respond to the bbb or my calls, emails, faxes, etc. BMW USA advised me to contact NHTSA. On June 1, while driving on city streets, the brakes were squealing even without engaging, and the car overheated/ backfired again/ almost caught fire.

9 Vehicle Speed Control problem of the 2014 BMW X3

Failure Date: 01/14/2024

On December 27, 2023, vehicle was taken to the service center of the dealership where it was purchased. The primary concern was that the car would at times suddenly launch forward and increase in speed on its own. Employees/repairmen test drove the vehicle, scanned the codes and the concern was not duplicated. On January 14, 2024, when slowing to park this vehicle, it suddenly raced forward, causing driver to hit a post. I have this documentation. Vehicle was totaled (at loss to me). I need some remedy.

10 Vehicle Speed Control problem of the 2021 BMW X3

Failure Date: 10/17/2023

The contact owns a 2021 BMW X3. The contact stated while driving approximately 3 mph, and slowing to park the vehicle, the vehicle independently accelerated. The contact stated the brake pedal was depressed. The contact stated no warning light was illuminated. The contact had taken the vehicle to a local dealer, where it had not been diagnosed. The vehicle had not been repaired. The manufacturer had been informed of the failure. The failure mileage was 28,307.

11 Vehicle Speed Control problem of the 2020 BMW X3

Failure Date: 03/20/2023

This car does not have an accurate speedometer. The analog dial only marks the mph number every 20 miles (eg numbers shown for 20 / 40 / 60. But not for 10 / 30 / 50). So impossible to easily or safely see the speed you are going. There is no digital speedometer showing the mph number.

12 Vehicle Speed Control problem of the 2007 BMW X3

Failure Date: 02/27/2023

The 2007 X3 BMW suddenly accelerates when stopped. This has happened multiple times' and is extremely dangerous. I have to put the vehicle in neutral and hit the gas pedal to stop it from racing. No codes come up when my mechanic scans the computer.

13 Vehicle Speed Control problem of the 2014 BMW X3

Failure Date: 02/07/2023

The contact owned a 2014 BMW X3. The contact stated that while driving at approximately 35 mph, she lost control of the steering wheel, the vehicle suddenly jerked to the left, and she crashed into a cement light pole. The chassis stabilization warning light was illuminated intermittently. The driver's side air bag had deployed. The contact stated that she hit her head on the steering wheel but had declined medical attention. A police report was filed. The contact made a local dealer aware of the failure; however, the vehicle had not been taken to be diagnosed or repaired, and the contact was informed the VIN was only included in an emissions recall. The contact stated that the obd monitor was removed when the vehicle was previously impounded. The vehicle was towed to a tow yard and was deemed totaled. The manufacturer was made aware of the failure. The failure mileage was 74,526.

14 Vehicle Speed Control problem of the 2021 BMW X3

Failure Date: 01/25/2023

I was slowly pulling into a parking space and as I applied pressure to the brakes, there was no response. In fact the car seemed to rev up and accelerate, jumping the curb and ramming a tree. I was able to steer away from the tree to avoid hitting the center of the front end, but smashing the left front. Even after hitting the tree the car did not slow and I’m trying to pump the brakes, there was no response… I kept going over a grassy area, across a sidewalk and back into the driveway in front of the building, finally the brakes engaged and the car came to a stop. I was then able to pull into another space safely out of the way. I was so lucky it was only 7:15 am and no pedestrians were around and no other vehicles. So I did not hit anyone and did not injure myself.

15 Vehicle Speed Control problem of the 2022 BMW X3

17 Vehicle Speed Control problem of the 2013 BMW X3

Failure Date: 02/27/2022

My wife was driving the car (her main, work car) with our 13 year old. She called me upset and told me that the car would barely move. This was disturbing. She was in heavy traffic. Also the car has been mostly reliable and we only have above 120k on the vehicle after almost 10 years. My wife slowly made it down busy stocton blvd. A few hundred feet and safely made it to a business parking lot. I came ASAP. (20min later). There was a message from the car - "drive train malfunction " it looked very serious. (note: my wife is about the best, skillful and careful driver I know. Especially for a person originally from foreign country (china). I gave my wife and child my car and took over the situation. The car would only putt along at 5 mph. So with my emergency flashers on I drove it all the way home using the shoulder. Its about 5 miles home, (more or less). It was pretty crazy situation with how fast people drive on 65th street expressway. This was my fastest route and only option. Before this a firestone happened to be just across the street where my wife had parked it so I ask if they could help. "not today" was their answer. I called BMW of elk grove, CA. Where we have always have taken it. Monica at BMW told me it sounded like a recall that had been happening. This was relieving since we haven't been financially well off. It was already 4-5pm so that's why I made the decision to try to make it home. At home I could get my affairs (phone) numbers in order and call for a tow in a much safer place. The unsafest part was getting the dangerous 5-10 miles home. It was Sunday but monica at BMW said "no problem " just drop it off and they would look at it Monday morning. BMW is telling me over $1800 just to inspect. Not to mention how much for a new timing chain. Monica didn't tell me how much that us. I since looked it up. That's when I saw several similar stories of 2013 X3's which seems much more than coincidence so I'm writing you. Thank you for the opportunity.

18 Vehicle Speed Control problem of the 2022 BMW X3

Failure Date: 11/09/2021

Limpmode: life threatening failure of vehicle shutting down accelerating in heavy traffic in speeds over 70 mph. On 9 Nov 22 I was driving on interstate to take my wife to her radiation appointment. Within 1 mile of exit, traveling in far-right lane in 4 lanes of heavy traffic with an additional two lanes of heavy traffic merging in from the right, I had to get over into the merging oncoming traffic. When I went to accelerate to merge right into the heavy traffic, my BMW dash lit up red and the acceleration was shut off leaving the car coasting. I could not accelerate, stuck in my lane the car started slowing from 70+mph traffic down to 60mph, 55 mph and I was able to get over into exit lanes at 45 mph with car still decelerating up exit ramp. I pulled off to the exit ramp onto the side of the road into the grass/pavement to safety. The BMW’s failure to operate was a life-threatening incident for me, my wife and mother in the car in the middle of very heavy traffic. In addition, all on-coming vehicle traffic was put at risk of life threatening injuries with a high risk of rear end multiple collisons. I sat looking at the dash reading and it read a few minor problems with sensor for pedestrians and cameras and if it proceeded to fail to contact maintenance, however the car was ok to drive. I shut the car off and restarted it and was able to get my wife to her appointment. I drove the car home with no issues. Vehicle was towed to dealership the next day at century BMW where it was purchased and informed by BMW mfg not to touch the vehicle. BMW n. A. Sent engineers to dealership to investigate cause. BMW n. A. Could not recreate environment, however choose to do repairs thought best to resolve issue. BMW n. A. Sent report to dealership for parts order and repairs. My many requests for trouble code reports from BMW n. A. And century BMW starting from 24 Nov 2021 to Jan 2022 were ignored. 18 Feb 22 partial rpt. Received by accident from service rep.

19 Vehicle Speed Control problem of the 2021 BMW X3

Failure Date: 07/12/2021

The car has part analogue part digital display, the mph is displayed only via the analogue dial in 10 mph increments. It's difficult to maintain speeds at 25 / 35 /45 /65 mph. The functionality exists to enable the digital speedometer but BMW refuses to code it on. Rather the company directs you to after market coders to enable the functionality. Alternatively you needed to opt to the $1000 optional fully digital display but this was not made clear at the sales process. BMW has a solution for the 2019 / 2020 X3 under sib 62 07 19 but refuses to acknowledge this at service centers.

20 Vehicle Speed Control problem of the 2015 BMW X3

Failure Date: 05/25/2021

Driver drove approx. 3. 5 to passenger’s home. While sitting & talking to the passenger for several minutes, the car suddenly, rapidly lurched forward, crashing into neighbor’s property. Substantial damage was done to the neighbor’s deck and brick wall at rear of the house. At least one piece of heavy lumber speared through the windshield between the driver and passenger. Vehicle is auto-shut off capable, however, the driver doesn’t recall if they shut the engine off manually, but believes it may have auto-shut off, while stopped before parking the vehicle. Driver recalls pressing the “p” button to put the vehicle in park. Driver said they were just sitting and talking to the passenger (ie driver was in a relaxed seating position, hands were not on the steering wheel, and feet not on the pedals). Driver said they attempted to hit the brakes after the vehicle lurched forward, but feels that they may have partially froze due to the shock of the unexpected acceleration. The passenger who also witnessed the event says the car seemed to go slowly for a split second then suddenly took off at extremely high acceleration. Passenger said prior to the car moving, the driver was pressing or had pressed the park button on the gear shift, when the car started to move, slowly at first (for a split second) and then suddenly the car took off at rapid acceleration. Driver said they recalled checking to see if the car was in park, which they noted is indicated by a red light (which they recall seeing). Passenger doesn’t recall seeing light on, but recalls driver pressing the p button at least twice. Vehicle owned since 2017, purchased with 24k miles, 1 prior owner (previously leased). Vehicle had about 50k miles at time of incident. Vehicle was always serviced at BMW of fairfax. No prior issues with the vehicle. The car was equipped with BMW oem rubber floor mats. No airbag deployment. The event occurred on or about may 25th, 2021 at 9 pm. Vehicle deemed total loss.

21 Vehicle Speed Control problem of the 2013 BMW X3

Failure Date: 05/17/2021

Vehicle indicated a drivetrain malfunction. It was determined by the dealer that the system that failed was timing valvetronic motor. The vehicle stalled as I was making a left hand turn off of a busy highway, putting myself and oncoming traffic at serious risk of collision. Oncoming vehicles were able to slow until I was able to maneuver the vehicle out of the lane of oncoming traffic. The dealer confirmed that they "found the vehicle stalling and not running correctly. Performed vehicle test. Found faults for valvetronic motor. Set multiple additional faults for mixture and air mass. Valvetronic is failing and should be replaced. " the vehicle component was inspected by the dealer who sold me the car. There were no warning lights nor other indicators of component failure prior to the vehicle stalling on the highway. This is the second time this vehicle has stalled in dangerous situations. The first time was a drivetrain malfunction/engine failure due to timing chain and timing tensioner malfunction. Most likely the valvetronic system failure is directly related to the timing chain tensioner malfunction. Both systems failed within a very short period of time, and within fewer than 4,000 miles of each other.

22 Vehicle Speed Control problem of the 2021 BMW X3

Failure Date: 04/12/2021

On April 12, 2021 I was driving my 2021 BMW X3 and as I was pulling up into a parking stall, my vehicle accelerated on its own causing my vehicle to collide with a brick wall.

23 Vehicle Speed Control problem of the 2011 BMW X3

Failure Date: 02/22/2021

While driving on a motorway at moderate speeds of about 45 mph, vehicle started throwing dynamic stability control, engine check light and traction control deactivation warnings and started cutting out power to the wheels although the engine continued to idle smoothly. Stranded on the motorway for a while and then after switching off and switching on the ignition couple of times, vehicle started to drive forward in limp mode. Had to pull over for safety and towed the vehicle to a local mechanic shop. They said the accelerator pedal failed and stopped sending any signals to engine control unit. They replaced the gas pedal and everything seems to be back to normal.

24 Vehicle Speed Control problem of the 2013 BMW X3

Failure Date: 02/02/2021

The system that failed was the timing chain and chain tensioner. The vehicle stalled while I was driving on the interstate. Immediately, I had no power and had to maneuver the vehicle to the emergency lane, placing me and other drivers in extreme danger. The problem was inspected, confirmed and repaired by the vehicle dealer. Prior to stalling, there were no warning lights to indicate a problem. The lights did come on simultaneously with the engine failure.

25 Vehicle Speed Control problem of the 2021 BMW X3

Failure Date: 12/16/2020

My car's speedometer only displays speed in 10 miles increments, which makes it nearly impossible to know exact current speed of the car. For example when speed is between 50 and 60 I can only guess what my actual speed is, 52 or 58. BMW for some strange reason sells an optional package which enables accurate digital speedometer, and I think accurate speedometer must be standard. This is a safety issue.

26 Vehicle Speed Control problem of the 2019 BMW X3

Failure Date: 07/01/2020

The speedometer is inaccurate. BMW told me that they have a directive which states that it is normal for a speedometer to be off by up to 7mph. They told me it is impossible to recalibrate. I do not know my true speed which is dangerous and makes it difficult to know if I am driving within posted limits. It also adds false mileage to my vehicle as it always indicates a speed higher than I am actually maintaining.

27 Vehicle Speed Control problem of the 2019 BMW X3

Failure Date: 10/18/2019

The digital speedometer reads in kilometers per hour, instead of miles per hour, so I do not know how fast I am going. A couple of months ago, BMW issued a recall related to the reverse camera on the 2019 X3. To repair this recall, the software in the car had to be upgraded. After the dealership repaired the recall issue and upgraded the software, the digital speedometer malfunctioned. The speedometer defaulted to kilometers per hour every time I started the car. It would not stay on miles per hour. Thus, after every start, I would have to go into the main menu and switch the digital speedometer to miles per hour. I took my car into the dealership today to fix the speedometer issue (so it would stay on miles per hour), and they made the situation worse. The option to switch the digital speedometer from kilometers per hour after every start to miles per hour has disappeared. The digital speedometer is now permanently stuck in kilometers per hour (and cannot be switched to miles per hour). Because of this issue, I do not know how fast I am going (which is a major safety issue), and also makes it difficult for me to know if I am breaking the speed limit and thus susceptible to getting a speeding ticket. The dealership advised me that dozens, if not hundreds of people, have complained about the issue and BMW is working on a software fix, but advised that it could take months. I find this absurd for a significant safety issue. There is an analog speedometer in the dash that is in mph, but it is difficult to read and not specific enough (it increases by 20 mph; for example, 0, 20, 40, 60, 80, etc. ). The analog speedometer does not have sufficient specificity to tell whether I am going 22 or 39 mph. The design of the analog speedometer is extremely poor and cannot be relied upon to determine actual speed, which is why the digital speedometer is critical.

28 Vehicle Speed Control problem of the 2015 BMW X3

Failure Date: 10/16/2019

I was about to park in a parking lot, driving slowly and carefully between two parked cars. As I very gently put my foot on the brake to stop, the car jolted intensely and did not stop. I then pressed on the brake pedal harder but the vehicle accelerated to a very fast speed. I drove through some large plants and went over a side walk and made a sharp turn to avoid a large building in front of me. I then drove through the parking lot, maneuvering around parked cars, buildings and other objects while the car was speeding up. My efforts to slow the car down failed even after applying auxiliary brake. Luckily there were no pedestrians or moving cars while this was happening! finally I ended up driving up a hill, hoping that the elevation would stop the car. Instead due to high speed, the vehicle was lifted up about 7 feet in the air, hit a large tree and fell in the ground with much force. I have some injuries as a result and currently receiving medical support, hoping that I will not have permanent health issues, which I very much doubt! my car was severely damaged and was totaled. It is clear and evident that there was some kind of technical malfunction that caused the brake failure and acceleration. I contacted BMW dealership where we had purchased the car and also where I had the car serviced one month earlier! they said I must pay for the car to be delivered to their facility in order for them to examine the cause of brake failure. I refused to pay the high price. It is also important to mention that I have been driving for over forty years and I consider myself a very capable driver. I should also add that on the internet there are at least a dozen similar reported cases of this model. Obviously, BMW has neglected to look into this matter. They should investigate their X3 models before someone dies!.

29 Vehicle Speed Control problem of the 2015 BMW X3

Failure Date: 12/10/2018

My car was stationary or in very slow motion and then suddenly went into a very high speed on my driveway ramp on its own. The brakes would not work till I went into someone's lawn and as it skid on the grass it gradually stopped. I almost had a near fatal accident. I have a witness who was taking a walk and saw the car suddenly fly at a very high speed and was beyond control.

30 Vehicle Speed Control problem of the 2017 BMW X3

Failure Date: 10/18/2018

This complaint is a follow-up to earlier complaint to NHTSA 11129293. As noted, I experienced 3 revving incidents in which the engine accelerated uncontrollably to over 7,000 rpm and was difficult to control. Fortunate, the vehicle was stopped on each occasion and did not surge ahead while I pressed firmly on the brake and shifted to neutral. The revving stopped on its own after a short time. In each instance I delivered the vehicle to a BMW dealership--the first time in sarasota, FL and then twice in rockville, MD--and BMW mechanics were unable to find any cause or flaw. Following the third event, BMW of north America despatched an engineer to rockville for a complete exam on October 4, 2018. The engineer reported the vehicle to be in perfect running condition in every respect. Based on this report, BMW na refused my request to terminate my lease early, without penalty. It also dismissed my personal view that the problem might be a software glitch that the engineer or BMW mechanics had been unable to uncover or duplicate. As my wife and I were unwilling to drive a car on public roads that we considered to have a life-threatening defect, we submitted to BMW's demand that we pay off in a lump sum the remaining two years of our lease through September of 2020, amounting to over $17,000. BMW's policy of refusing to accept resposibility for revving problems undoubtedly forces some drivers to keep driving potentially dangerous vehicles, risking public safety. I am also appalled at the likelihood that BMW has leased or resold the same vehicle, thereby profiting twice for the period of my terminated lease, while failing to reveal the car's history of revving to the new owner/driver. I have documents such as the BMW engineer's report, email correspondence with BMW of north America, etc. Unethical.

31 Vehicle Speed Control problem of the 2016 BMW X3

Failure Date: 09/03/2018

A very dangerous and catastrophic situation is created when using the start/stop feature. When stopped at a traffic light or stopped in stop and go traffic on the highway this feature fails. Once this feature is engaged when the vehicle is stopped when the accelerator is pushed to start again the vehicle goes into park instead of accelerating. This presents a very dangerous and potentially catastrophic situation because you may be making a maneuver by acceleration to switch lanes or something similar and the car fails and goes into park and does not move. Perillo BMW performed unsuccessful service on this approximately four weeks ago. This did not fix the problem. Perillo performed service again for the same issue two weeks ago. My hope is that this is a permanent fix because to not take this problem seriously and leave it to chance that this may occur with severe consequences. This is a safety issue that I think the NHTSA should address directly with BMW. Specifically- 1. The car comes to a complete stop at a traffic light, stop sign or in stop and go traffic on the highway. 2. The start/stop feature is engaged 3. When the accelerator is pushed to go again the car immediately goes into park and the steering wheel locks. 4. To go again, the break must be pressed and the gear shifted manually into drive. Prior to BMW servicing the vehicle this has occurred more than 20 times in a three-month period. There is absolutely no chance that the driver accidentally pressed the park while stopped. The driver purposely does not keep their hands on the shift gear.

32 Vehicle Speed Control problem of the 2013 BMW X3

Failure Date: 02/17/2018

Last week when in city traffic, I depressed the brake to slow down, then lifted my foot off the brake. My car lurched forward and I immediately braked again to slow down and stop. This was not normal, had not happened before, and I decided to mention it during my next visit to BMW service. Last Saturday, Feb. 17, I was driving 20 -25 mph in a neighborhood, approaching a red light on river rd, bethesda. There was one car at the light. I braked to slow down, and realized that the car was not slowing down, braked again and it lurched forward and accelerated. I saw the speed the speedometer moving between 20-25, and the tachometer varying wildly between 1. 5 - 2. 5. I pressed very hard on the brake, which was harder to press down than ever before, pressed the park button and finally got the car to go into park before I arrived at the stopped vehicle in front of me. This all happened in less than 10 seconds. I immediately called BMW and took my car in, explaining what happened, still very shaken and afraid to drive the car. Afterwards, I looked on the internet, and read about other 2013 X3 drivers with the same experience. It did not appear that BMW was able to replicate the problem or that they repaired the cars to fix the problem. One person did have an accident and totaled the car. Thus far, BMW has told me they cannot replicate the problem. I requested the service manager to get involved and will ask to speak to the factory rep as well. This is a major safety hazard putting my life and others at risk. It is not safe to drive my car. I would like to know how many similar complaints have been filed with NHTSA and what NHTSA has done to address this serious safety flaw.

33 Vehicle Speed Control problem of the 2012 BMW X3

Failure Date: 02/08/2018

I was have issues with the vehicle hesitating and jerking, and generally not operating as expected. I took it in to be checked as I was concerned for operating it safely. The dealership indicated that it requires a software patch, as their is a code error, but they will only fix it if I pay for the patch. I told them that if it is a patch that seems like a recall - software is not hardware, software does not just stop working if it is good to begin with. If we allow car dealers to make us pay for patches when they mess up software we will all be paying hundreds and thousands of dollars for their coding errors going forward as the technology continues to innovate. I am all for innovation, but I should not be paying for their coding error. My car worked a few months ago, I took it in for service under warranty for a different issue, they did work to the onboard software that likely caused this issue, and now that it is out of warranty they have decided that is my problem to fix what they broke. This is a precedent that I do not think we should allow auto makers to set. A car is not a pc that we replace in 4 years - it cost exponentially more. When microsoft requires us to upgrade or they will not patch anymore it is on a pc that cost $1-2k at max, we are talking about a much larger investment and BMW should not be allowed to just stop fixing their code and charging consumers for errors that are potential safety concerns. I do not care if the code is original or installed at my last service visit. Something is seriously wrong with this picture. I would feel different if I had some custom modification, then I think they could blame me for hacking it, but I did not do so, therefore I should not be penalized.

34 Vehicle Speed Control problem of the 2013 BMW X3

Failure Date: 01/26/2018

I was driving down the interstate at 75mph and put the car into sport mode, it suddenly went from 2000 rpm cruising to 6000 rpm and back to zero. The car had lost complete power. I pushed the gas and nothing happened; luckily I was able to coast to the side of the road and pull over. I tried to restart the car but nothing happened. The radio, air, and windows still worked but nothing else. I had aaa tow the car to the closest BMW dealership. The BMW dealership called me to ask if I had a dead battery; I told them batteries do not die driving down the interstate. BMW then called me back to tell me that the engine seized and it was total failure, but they could not tell me anything specific when I asked. They said I could pay $6,000 in labor to have a mechanic rip it apart to find the exact cause and then pay the additional cost to have whatever was broken replaced or that I could go ahead and pay $10,000 upfront to have the engine replaced. A 2013 car, that has routine maintenance should not have this happen. I could have been in a serious accident from this, and now I have no car to drive.

35 Vehicle Speed Control problem of the 2011 BMW X3

Sua. I was in a frightening accident attempting to park my car on the rooftop of my 4 story office building. I pulled into a space on the edge of the lot and came to a complete stop. My foot was on the brake, I was about to put the car in park when the engine loudly and suddenly revved and the car surged forward up onto a concrete curb and rammed into a 4 ft high concrete retaining wall. The force of the impact tore the wall apart from the roof - my car was still accelerating, wheels spinning. The broke wall stopped by car from completely going over and I was able to turn the engine off and get out. There were witnesses who can verify that I was at a complete stop, brake lights on and it all happened in a few seconds. It was so shocking that I will never drive a BMW again.
