No injury or damage to other vehicles occured as this transpired on a residential street at low speed. Concern regarding failure at highway speed or in congested area. No prior warning of failure.

(1) nothing before it happened. (2) I was driving to work at 10:50 pm and as I made a right hand turn into the parking lots at about 5-10 mph, I heard a clank and bump bump. I turned and saw nothing and slowly moved forward where I saw a tire in the road behind me. I turned around and went back and saw it was a good tire and rim about the size I had on my car. I looked under my car and to my suprise my spare was gone. I picked up the tire and metal bracket that held it. I could not find anything else. The next day in daylight I looked under my car and found that the cable that holds the spare tire was broken at the point where it came out of the bracket. (3) I took the car to my local dealer and he didn't look at the car but said he had never heard of this happening before. I asked him to fix it free and pass this info up the ladder as this was a serious accident waiting to kill someone. I told him the day before I had been driving on the interstate @70 mph and if it came off then I was sure I could have killed someone. He said I was lucky, but he couldn't fix it for free and my car was 5 years old. I told him this was a safety issure and the spare tire had never been put on the car. Nothing he could do but gave me an 800 number to call. I did and got nowhere with them either, I did get a reference # 0420083070. I'm almost scared to drive the car, as the spare tire could come off and kill someone.
I experienced a continental tire tread separation while driving on the freeway at about 65 mph today. The tire tread caused considerable damage to the side fender/bumper and side step panel after the tread separation. The car is a 2000 Lincoln Navigator id # 5lmeu27a2ylj42308 which I just purchased on July 6, 2003. The tire was a continental SUV p265/70r17 113s that appears to be the replacement tire for a continental tire recall in August 2002 (NHTSA campaign id number: 02t012000) dealing with the contitrac aw and grabber aw tires size p275/60r17 for use as original equipment on certain 2000-2001 by two-wheel-drive Ford expedition and two-wheel-drive Lincoln Navigator sport utility vehicles. The spare tire that was then put on the car looks to be the original equipment spare tire. It is a continental aw tire, p275/60r17 100s that appears to be the tire that was covered under the recall. I would like know how to correctly identify the spare tire I am now riding on as to whether it is the tire that was recalled and if so as to how I can get it replaced. Also, as to who is going to pay for the damages that the tire has caused and as to how I can get the tire replaced because of apparent manufacture defect. Also, if the spare is one covered by the recall how is it that the car dealer I purchased it from only two months ago did not have it replaced or at least notified me of the defective product that would / could prove fatal to myself or others?.

We have had our Navigator into the dealership a total of 8 times in the last 3 years. The following had to be replaced: sunroof, groaning noise from beneath the hood (in 4 times for this still not corrected), cd player replaced, sterio replaced, heating elements both front seat replaced 2 times each, incorrect lug nuts, incorrect tire wrench, shaking in stering @ highway speeds-still not corrected, lift system broken-not fixed, hood latch would not release, fuse blowen 3 times for ac outlets, check suspension light on, check engine light on, rear turn sigal out, passenger window catches, incorrect spair tire. (tiresize: p265/70r17).
