Failure Date: 05/25/2016

Experienced three instances of unintended acceleration. The third instance of unintended acceleration was extremely dangerous and brakes would not stop the acceleration and forward momentum. Had to put the car into neutral to stop the forward movement while applying the brakes. It still took approximately 10 seconds for the throttle acceleration and spinning tires to stop. Floor mats were original Lexus installed carpet mats and checked to see they were properly installed, and they were. After the first instance of the unintended acceleration, I was diligent in ensuring my foot was in the middle of the brake pedal and not inadvertently on the accelerator. The fact that it occurred two more times, with the last instance being quite severe while I properly applied the brakes point to a problem with the electronic throttle control system. Reported the incident to Lexus and allegedly they will investigate. I never received any recalls on this vehicle from Lexus and had the vehicle serviced every 5k miles and the dealership never mentioned nor took action on the recall specified in NHTSA case number 09v388000.

I was pulling into my garage slowly, braking to stop, when the can accelerated. I could hear the engine rev and I pressed hard on the brake and put the car in park. The car traveled about 4 feet before it came to a stop. I reported to Lexus who turned over to 'legal' and I have been waiting for a week for an investigator to contact me to look at the car, after which they say it will be another 30 days for a finding. The paperwork I filled out termed this as 'unintended acceleration". This is the second time this has happened with this car, which I purchased new and have had for a little over a year.

While entering my garage, my car suddenly accelerated and smashed into the rear wall destroying a cabinet and refridgerator and went through the wall. I couldn't stop the car as evidenced by brake skid marks on the garage floor. Lexus later inspected the car and claimed they could find no defect. Fortunately my wife and I were only shaken up from the deployment of the airbags. The car was totaled. My home and auto insurance covered part of the damage and Lexus has disavowed any responsibility, but they never inspected the damage to our home or the evidence that I was trying to stop the car almost from the instant it entered the garage. Petition for a defect investigation into low-speed surging in different models of Toyota automobiles in which the car starts accelerating and the engine rpm increases when accelerator is not depressed. The consumer stated on February 13, 2015, his was driving to an appointment. She pulled into the parking lot and did not have her foot on the brake pedal as she was coasting into the parking spot. The vehicle suddenly accelerated. Bushes in front of the vehicle limited the speed, so his wife turned off the ignition and the vehicle fell back. A witness saw the entire even and attested to the fact the engine suddenly started roaring. The front of the vehicle was smashed. There were no injuries. The vehicle was towed and inspected. The edr readout provided no evidence that the incident was the result of any type of design or manufacturing defect.

The contact owns a 2008 ES 350 Lexus. While driving 15 mph, and approaching a traffic light, the vehicle suddently accelerated excessively and crashed into another vehicle. There was no damage to the vehicle, nor were there any injuries. The contact's vehicle sustained minor damage. He notified the insurance company when the crash occurred. There was no police report. The vehicle was repaired. The failure mileage was 43,000.

On Monday August 6th, 2012 at approximately 5: 25 am, I ([xxx]) was arriving at work at methodist hospital. I pulled in the parking lot and started to make a wide u turn into a parking stall driving about 5 miles per hour. My car suddenly accelerated and the brakes would not work and I was unable to stop the vehicle. I kept trying to brake to no avail. I went through a fence and drove over a steel pole. Just as I was about to hit a very large tree, the car finally stopped. The brakes finally work about 3 to 4 feet in front of the tree. I was able to drive around the tree and park like I do every day. After parking, I got out of the vehicle, got my phone from my purse in the trunk and called my husband and told him what had just happened. I was very shaken and crying. The car was wrecked on the passenger side. [xxx] called security & [xxx] came over. We both went back out where the accident happened. I showed him where it happened, what happened and where I ended up. [xxx] told a few photos. We have contacted Lexus [xxx] #2 option (judy)and our attorney ([xxx]) [xxx]. We have taken the vehicle to Lexus of omaha. Lexus wants us to sign a black box release. Our attorney suggest we turn in a claim to see if farmers wishes to see the black box 1st. . The contact owns a 2007 Lexus Es350. The contact stated that while traveling 20 mph, the floor mat made contact with the accelerator pedal, causing the vehicle to erroneously accelerate. The contact was able to safely merge off the roadway to remove the obstruction. The vehicle was driven to the dealer where it was determined that the floor mats were not the original equipment mats and advised the contact to purchase new floor mats. The manufacturer replaced the floor mats only to experience the same failure. The manufacturer was contacted about the issue. The failure mileage was 59,000 and the current mileage was 87,000. The contact owns a 2007 Lexus Es350. The contact stated that the driver was traveling 70 mph when the vehicle suddenly accelerated. The driver applied constant, abrupt pressure to the vehicle but to no avail. In order to stop the vehicle, the driver shifted to neutral which caused the engine to exhibit an extreme increase in rpms. She then inspected the accelerator pedal to determine if it was stuck but noticed that the floor mat was atop the pedal. The contact rented a Lexus 2010 Es350. The contact stated that the vehicle suddenly accelerated as the brake pedal was depressed, causing her to crash into the rear of another vehicle. The contact owns a 2008 Lexus Es350. The contact owns a 2008 Lexus Es350. While cruising 60 mph the Lexus suddenly accelerated to over 90 mph. Contact stood on the brake as hard as he could and switched the ignition off, but the car continued revving as high as the motor would go. Finally, the contact was able to get the car into neutral to slow down. However, by then the brakes were red hot. Contact pulled the coil wire to stop the motor from blowing up. After, the contact's terrified wife and children calmed down from the near death experience, the Lexus was towed to a Lexus dealer. The contact called and wrote the dealer for weeks but only received a response after threatening legal action. Toyota of America then sent a representative to erase the onboard computer data proving even Toyota thinks its unintended acceleration is electrical, not mechanical. However a month or so later, the car suddenly accelerated getting up to speed of approx 70 mph in a residential area. Brakes did not stop or slow car down. As a result, two parked cars were hit, and damaged residents yards before running head on into a tree in someone's yard. The driver and passenger were injured.

On 4-26-10, while in cincinnati ohio, I was the passenger in a 2008 Lexus Es350 . We were going to kroger. The driver stopped at a stop sign and after leaving the stop sign the car suddenly accelerated all by it's self to a very fast speed. Due to the car's excessive speed, the car left the street and hit 2 other vehicles & a tree. Special note: since this type car was part of a recall. Prior to the accident the owner / driver of the car had taken the car to the dealership to be "fixed" as indicated in the recall letter.

She depressed the brake pedal but the vehicle continued to accelerate. She stepped on the brakes again and engaged the emergency brake but the vehicle continued to accelerate for about two miles. The vehicle finally stopped and the contact pulled to the side of the road. The contact called the manufacturer who advised him to take the vehicle to an authorized dealership. The contact was uncomfortable driving the vehicle and opted not to. The current and failure mileages were approximately 14,000.

I am requesting that dot NHTSA investigate the driver's contribution to unintended acceleration (ua) due to programming code error. I am driving at 40 mph. I see signal light turning red. I took my foot off accelerator. The car is coasting. When speed reached 20 mph, the car suddenly started accelerating. I stepped on the brake. Car started slowing down. I reported this to Lexus headquarter on 03-01-10 (Lexus incident. ) I was asked to drop off my car at dealer on 03-30-2010 so that field technical specialist can investigate. I was asked to pick up my car on 03-31-10. I requested copy technicians findings and report. As per technician's report, "we were able to duplicate his concern. What is happening is that as the vehicle slows down the torque converter lock up is turning off. This reduces the amount of engine braking and gives the feeling that the vehicle has sped up. We compared this to another Es350 and it has the same characteristics. No repairs made, vehicle is operating as designed. " I wrote Lexus head-quarter again saying, "this is not a feeling I experienced. It is a real issue. I noticed speedometer reading rising. " I received a phone call from Lexus headquarter indicating there is nothing more they can do. I asked, "can your technician repeat the test with me in the car with him?". They said, "it is not necessary". Since my foot was not on accelerator or brake when car started accelerating, I suspect programming code error. My car was already repaired during safety recall by Lexus some two months ago. So, this is not a stuck accelerator issue. I request your assistance in having Lexus repeat this test with me inside the car to witness their test. They have refused to do this. Car was purchased brand new from sterling mccall Lexus, houston in December 08. It is Lexus 2009, ES 350. Car is barely used since we bought it 16 months ago. It has 3,300 miles on it. All routine required maintenance was performed by dealer.

C. 552(b)(6) on February 23, 2010 at about 3 pm I was parking my 2007 Lexus Es350 in a parking space at starbucks at belgrade shopping center. When I reached the curb with my foot on the brakes I started to put the car in park and suddenly the car just took off up over the curb. I kept pressing harder and harder on the brakes with my right foot and applied the parking brake with my left foot. The car traveled up over the curb and into the grassy - wooded area beyond the parking lot. The car finally stopped. Lexus was notified and towed the vehicle to Lexus of richmond, va where the recall repairs were made. We have been afraid to drive the vehicle for fear of injury or death due to a future unexpected sudden acceleration happening again. 2007 Lexus Es350. Complained twice to dealer about unexpected acceleration. Dealer initially said there was nothing wrong. Second time they indicated it was a computer glitch and "flashed" the system. This has not taken care of the problem. Was told to keep complaining, so that Lexus would eventually find a fix. Problem remains. . . . When you approach a red light and begin to stop, then the light changes to green. . . When you go to accelerate, the transmission "jumps" and accelerates unexpectedly. I haven't had an accident, but am afraid that I'll hit another car. This is not a one time occurrence.

The vehicle was involved in an accident caused by sudden acceleration. The driver was stopped for a red light. When the light turned green, the driver release the brake and then the vehicle accelerated on its own and collided with the vehicle ahead. The accident was reported to the Lexus as a product liability case, caused by a sudden or unintended acceleration. The vehicle was inspected at the magnussen Lexus dealerships, fremont, California by Lexus technicians on January 26, 2010. On February 10, 2010 the Lexus claims administrator sent us a letter stating that the vehicle revealed no evidence of any vehicle defects. I reject this assertion by Lexus and hereby requesting that NHTSA investigate this matter.

I was driving a 2008 Lexus ES 350 down wisconsin avenue in bethesda, MD and was stationary at a red traffic light at the intersection of wisconsin avenue and bradley blvd. When the light changed to green, upon lightly pressing the accelerator to get my car moving again, it started to rapidly accelerate (out of my control) and, despite my pressing the brakes with full force, the car was moving very fast and stopped only after a few hundred feet, when it crashed into the vehicle in front of me. That vehicle crashed into another vehicle in front of it. A car hit me from behind as well. My airbags went off and my car was damaged so much that it had to be towed away. I am convinced that this accident was caused by a accelerator defect in the car. This is consistent with the ongoing Toyota investigation into accelerator defects in my car model. I am lucky that I survived. Had I not been in heavy traffic, that forced my car to stop, I can only imagine how much more speed I would have gained resulting in likely much greater damage to life and property.

On October 1, 2009 my 2008 Lexus ES 350 experienced uncontrolled acceleration. Upon entering the highway the vehicle increased in speed to approx. 90 mph without depressing the accelerator. The vehicle did not stop or slow down even after stepping forcefully on the brakes. I pushed the start/stop button on the dashboard numerous times and the car would not stop or cut off. Somehow, through the grace of god I begin shifting the gears, once the gear was placed in neutral the speed finally broke and the car slowed down. The vehicle was steered to the side of the road where the car had difficulty coming to a complete stop. Once the car actually stopped I called the Lexus dealership and a flatbed was sent and the car was towed to the dealership for service. The Lexus service department determined the damage consisted of burnt front pads and rotors and burnt rear pads and rotors that all occurred while trying to stop the runaway vehicle.

Failure Date: 02/03/2009

Driving home from work, I experienced a sudden uncontrollable surge in acceleration causing my speed to increase from about 60 mph to 80+ mph. Immediately I began to brake hard as I was rapidly approaching traffic just ahead of me. Fortunately the inside left lane was unoccupied and I was able to make an immediate lane change. Initially I depressed the brake pedal as hard as I could using both feet but only managed to slow the vehicle to 40-45 mph. With my speed reduced, I alternated between pumping the accelerator pedal and pulling up on it from the underside with my right foot as it became clear that the throttle was stuck in an open position. The vehicle continued to speed back up to over 65 mph with less pressure on the brake pedal. With traffic just ahead of me, I moved over to the left shoulder next to the center barrier and continued to try to release the open throttle. There were clouds of smoke around the vehicle and the smell of burning materials from the overheating brakes. After finally getting the vehicle slowed down to about 25-30 mph, I shifted into neutral and depressed the start/stop push button a number of times hoping to stop the engine but nothing happened. Instead the rpms moved up into the redline range on the tachometer. I quickly shifted back into drive; the vehicle jolted and rapidly accelerated to 60+ mph. As the brakes were fading quickly, I was certain that I would need to shift back into neutral and let the engine blow up to stop the vehicle. Suddenly the acceleration surge stopped and I was able to bring the vehicle to a stop about 1 â½ to 2 miles from where it had started. I quickly shifted into park and depressed the start/stop push button to turn off the engine. The vehicle seemed to shutter as I did so. Upon restarting the car, I drove cautiously to Lexus of wayzata a short distance away fully prepared to shift into neutral if the acceleration repeated. The car remains there over 5 weeks later.

While backing my 2007 Lexus ES 350 up my driveway, the vehicle unexpectedly accelerated and crashed into the corner of my garage. Although driving carefully and slowly, the vehicle jolted back as if the fuel injection system had kicked in. No one was injured, and I did not file an insurance claim for resulting damage to the car or the garage.
