The vehicle is experiencing sudden engine stalling while in motion, a known safety hazard. Despite a documented maintenance history with no issues, the dealer (bayside kia) is attempting to deny a theta ii settlement claim by shifting the narrative to 'engine sludge,' which only appeared as a symptom in June 2025( walmart oil change) alongside engine performance issues. The vehicle has active codes p0014 and p0017, which are secondary symptoms of the internal bearing wear and metallic debris contaminating the oiling system. Kds diagnostic tests showed cylinder 1 at 0. 16mm (approaching the 0. 20mm failure limit). This clearance proves the connecting rod bearings are worn and reaching the failure threshold; this mechanical wear is the root cause of the engine's inability to operate safely. The presence of metallic debris in the oil is the definitive signature of the theta ii manufacturing defect. Furthermore, the dealer acted in bad faith by attempting to charge for airbag repairs (codes b1346/b1481) that are covered under the 15-year clock spring warranty extension (cs1102). The dealer has dismissed my qualifying maintenance documents, claiming they are 'not official,' which is a direct violation of the magnuson-moss warranty act. A manufacturer cannot deny a warranty claim because services were performed at third-party facilities, nor can they deny a claim without proving 'exceptional neglect. ' I am reporting a refusal to honor a court-ordered safety settlement and an attempt to return an unsafe, stalling vehicle to the road. There is no evidence of engine abandonment or exceptional neglect. I’m considered "in compliance" if I can show I didn't go more than 14 months without servicing or a certain mileage between oil changes. The dealer's dismissal of verified third-party receipts and bank statements is a bad-faith attempt to ignore an inherent manufacturing defect documented by a 0. 16mm bct result and metallic debris.

Administrator national highway traffic safety administration (NHTSA) 1200 new jersey avenue se washington, DC 20590 USA subject: formal safety defect claim regarding unaddressed recalls — 2012 kia Optima hybrid (VIN: knagm4adxc5036228) from: alexander?pancioha email: pancheh5@gmail. Com phone: +32?465?794?320 vehicle information: - VIN: **knagm4adxc5036228** - make / model: 2012 kia Optima hybrid - mileage: approx. *,000 miles** - current location: moldova (vehicle manufactured in korea for the us market) --- ## summary of the problem I am writing to file a **formal safety defect claim** regarding my 2012 kia Optima hybrid, VIN **knagm4adxc5036228**, which, despite having documented recall campaigns, has never had critical parts replaced. As a result: 1. **internal scoring and scratches (zadir)** have been detected within the engine, consistent with **metal shavings / debris** circulating in the oil system. 2. There is **metallic residue (shavings)** found in the oil pump, which strongly suggests that worn or damaged components (likely from a manufacturing defect) were never replaced during the recall. 3. Given the extraordinarily high mileage (??250,000?miles), the continued use without the required recall repairs poses **significant safety risks** and potential for further engine failure or fire. 4. I was not provided with a proper remedy when recall notices were issued — in my case, the relevant parts were not replaced in a timely fashion (or at all), despite the recall campaigns being active, leading to the deterioration of the engine. --- ## legal and technical basis ### recalls applicable to my vehicle - NHTSA recall **20v750** for the 2012 kia Optima hybrid: this is a recall related to engine defects, including risk of engine fire. [oai_citation:0‡static. Nhtsa. Gov](https://static. Nhtsa. Gov/odi/rcl/2020/rconl-20v750-8140. Pdf?utm_source=chatgpt. Com) - NHTSA recall **23v652**: this relates to the hydraul.
The contact owned a 2012 kia Optima. The contact stated that, while stopped and attempting to complete a left turn an SUV failed to yield and collided with the front driver side of her vehicle. As a result, the contact lost control of the vehicle, spun across the intersection, and careened off the roadway only coming to a complete stop after colliding head-on with a tree. The contact also stated that the seat belt emergency locking retractor failed to deploy allowing her to jolt forward violently and hit her head on the steering wheel. The air bags did not deploy. No warning lights were illuminated. The vehicle was towed to a storage facility but had yet to deemed a total lost by the contacts insurance provider. A police report was filed, and injuries were reported. The contact was later transported to an area hospital and treated for chest pain and neck pain. The contact also received an mri due to possible concussion. The manufacturer was not notified of the failure. The failure mileage was 84,000.

Driving on [xxx] to eureka, CA. Just outside of laytonville, CA. The vehicle in front of me swerved into oncoming traffic lane (no vehicle in his way) to go around rock, then rock was there, I swerved to the right, but hit the rock, went up on embankment, flipped over and slid to a stop. There is an upcoming California highway patrol report from mendocino county, with support witness (pg&e employee) statement given to California highway patrol. No airbags deployed throughout the car. Pictures attached of inside and outside vehicle. No deployment of airbags was written into the report from auto wreak retriever. Information redacted pursuant to the freedom of information act (foia), 5 u. S. C. 552(b)(6).
The airbag light is on indicating an error within the system.

I was driving on the northbound side of the interstate when my brakes failed when I pressed them to avoid a collision on the highway. The steering wheel malfunctioned when I tried to avoid a head-on collision with another vehicle. I couldn't control or stop the car, causing me to swerve left to right, and I then completely lost control of the vehicle. I crashed into the middle of the highway, but because my brakes had failed, the car continued at full speed into the southbound side of the highway, causing me to wreck into a semi. The colorado state patrol investigated the accident. Right before I wrecked into the semi-trailer, I noticed all of the lights on the dashboard were off. My steering wheel had fallen off completely, but the airbag never deployed even though every other airbag had deployed.
What component or system failed or malfunctioned, and is it available for inspection upon request? the defects involve multiple electronic control systems, including steering, braking, and airbag modules, which continue to generate active and stored diagnostic trouble codes (dtcs) even after the may 2, 2023 recall repair. The vehicle remains in our possession and is available for inspection upon request. 2. How was your safety or the safety of others put at risk? because the vehicle fails to illuminate dashboard warnings, we were unaware of critical malfunctions occurring in real time while driving. This creates the risk of sudden failure in steering, braking, or airbag deployment, directly endangering both occupants and the public. 3. Has the problem been reproduced or confirmed by a dealer or independent service center? yes. Independent diagnostic scans repeatedly confirmed active and stored dtcs following the recall repair. These findings show the defects are reproducible and ongoing. 4. Has the vehicle or component been inspected by the manufacturer, police, insurance representatives, or others? the vehicle was inspected by kia’s authorized dealer, spradley motors in pueblo, CO, for the recall repair. Since then, diagnostic evaluations have been performed by independent service providers. Documentation of these inspections is attached. 5. Were there any warning lamps, messages, or other symptoms of the problem prior to the failure, and when did they first appear? no dashboard warning lamps illuminated, even though faults were recorded internally by the vehicle’s control modules. The absence of warnings despite active codes is itself the central safety issue.
As in may 2025 , I purchased 2013 kia Optima lx sedan with airbag already deployed before bought it. And in June 2025 I took my car to nearest kia dealership , I found out that I had recalls over other things as well. I made kia dealership to look at the airbag and do inspection on it. None of kia employees did not informed me about the airbag, carfax information about previous incident to this car before I purchased.
The airbag warning light on the dashboard stays on continuously and will not go off.

There is a clean slit on my dashboard where the passenger airbags are it’s started to form a complete square around the air bag placement and I’m worried it might have a problem with the airbags and its not just cosmetic. When I googled the issue there are tons of kia drivers with the same clean sit appearing over the passenger air bag. I contacted kia dealership and they said I’d have to pay for a diagnostic fee to determine if it’s a problem but there’s clearly a problem with the 2016 kia so I’m sure all of us owners would appreciate it being recalled.
Power train: at low idle or while slowing down, the car will lose power for a minute until you get on the accelerator and it all comes back on. Alternator had been replaced. And is going to be replaced again soon. Not sure if it's just a bad part. Power steering pump was replaced. The pulley seized. Unrelated. Lighting: third brake light constantly flickers. All lighting including head lights flicker on and off. Worse when slowing down. Lights on dash board, dome, rear light and head light bulbs have been replaced. At night when the head lights flicker I cannot see the road. Airbags: the air bag light on dash is always on. Codes have been ran and there are so many. Tried resetting codes it comes back on soon after. Not sure how to go about trying to fix it. All of this has been happening since I purchased the car in November 2024.

The contact owned a 2015 kia Optima. The contact stated that while at a complete stop at the red traffic light, another vehicle, driving off a highway ramp at an undisclosed speed, crashed into the rear-end of the vehicle. An unknown red warning light was flashing. The air bags did not deploy. The seat belts failed to restrain the contact as needed, causing the contact to hit her forehead against the steering wheel, which propelled the contact's head back to the headrest, and then the contact hit her forehead against the steering wheel for a second time. The contact was able to exit the vehicle but felt dizzy and off balance. A police officer filed a report and informed the contact that the vehicle was safe to drive. The contact was able to drive the vehicle to the nearby hospital, where the contact received medical assistance. The vehicle was later driven to the residence, where it remained parked. The contact sustained a concussion, bruises on the forehead, neck, and lower back back pain, a worsening of the contact's generative bone disease condition. The contact might undergo a back surgery. The vehicle was towed to an independent mechanic two months later. Both the mechanic and the insurance company confirmed that the vehicle was totaled. The manufacturer was notified of the failure and informed the contact that the vehicle operated as designed during the incident. The contact was referred to the owner's manual. The failure mileage was approximately 62,000.

I was in an accident on 10/18/24 where a person switched lanes and hit the front end of my vehicle. My airbags didn't deploy.
I brought my kia Optima into the dealership in October 0f 2024, because my airbag light came on. It has not been there over 6 months because my passenger airbag module is not operable and rending all my airbags useless; it is also on backorder with no eta. The dealership wouldn't help with my escalation it has taken me 6 months to get to the escalations department and now they will not offer additional support with payments or a buy back "due to warranty". I feel helpless and like my investment has been thrown in the trash and lit on fire as my car is sitting in the parking lot in the az sun, not being moved and not protected from the elements. They continue to offer no real resolutions and tell me to wait for a piece that has absolutely no eta.
The contact owned a 2012 kia Optima. The contact stated that the vehicle was previously repaired under NHTSA campaign number: 18v363000 (air bags) however, it failed to prevent the recall safety risk. The contact stated that while his mother was driving at approximately 45 mph with the grandmother seated in the front passenger seat, another vehicle cut in front abruptly and switched back into their original lane, causing the contact's mother to crash into the rear of another vehicle ahead. The air bags did not deploy. No warning light had illuminated. The contact's grandmother was taken to a local hospital for injuries including a swollen face, both arms harmed, broken teeth, 3 broken ribs, and back pain. The contact's mother was later taken in a personal vehicle to a local hospital for injuries sustained for bruising on their chest, back and neck pain, and an injured toe on her left. A police report was filed. The insurance provider deemed the vehicle totaled and took it to a tow lot. The manufacturer was made aware of the failure. The failure mileage was approximately 225,000.
Possible clock spring failure. Symptoms - air bag light remains on and lost functionality on left side of steering wheel. Not covered under recall, but 2016 year is covered. My vehicle appears to have a mix of 2015 & 2016 parts (specifically front brakes). No aftermarket changes to brakes or steering clock spring.
The contact owns a 2020 kia Optima. The contact received notification of new vehicle limited warranty extension (illumination of air bag warning light); however, the part to do the repair was not yet available. The contact stated that while starting the vehicle, the air bag warning light illuminated. The seat belt alarm chimed while the front driver seat belt was buckled. The dealer was made aware of the failure but confirmed that parts were not yet available. The vehicle was not repaired. The manufacturer was made aware of the failure and a case was opened. The failure mileage was approximately 42,860.
Airbag warning light continuously on, a 2018 recall that was repaired by kia dealership and seemingly recurring.
The dashboard has a crack around the edge of the passenger airbag. I am trying to find out if this is a safety issue for airbag deployment.
The contact owned a 2017 kia Optima. The contact stated that while driving at 35 mph, the contact was hit by another vehicle on the front passenger side tire. Due to the impact, the vehicle was sent over four lanes of traffic and jumped over a curb. The contact stated that front air bag deployed only after the vehicle jumped the curb; no other air bags in the vehicle deployed despite the contact's children in the vehicle's back seat. The contact stated that metal shrapnel was released upon deployment of the air bag. The contact used her left arm to block the fragments from hitting her face. The contact and her children were all transported to the hospital by ambulance. The contact sustained multiple cuts to her jaw, lips and face. In addition, the contact's sustained multiple lacerations and bruises to her left arm and the contact's right arm was broken; the contact also sustained eight cracked teeth. The contact stated that all four children located in the back seat suffered minor bruising with one child suffering a seat belt laceration on their right shoulder. A police report was filed. The children were discharged from the hospital on the same day; however, the contact stayed in the hospital for a week due to her injuries. The other driver's air bags deployed upon impact and no injuries were reported. The vehicle was towed to an independent mechanic were it remained in their possession pending. The manufacturer was notified of the failure. The vehicle had been deemed a total loss. The failure mileage was approximately 110,000.

I was rear ended hit so hard it smashed my whole back end in. None of my airbags deployed. We were hit hard into the center medium of the highway. Lucky no rigs were coming through. Other parties insurance totaled out my vehicle.
There's something going on at the kia dealership in wake forest (westgate). Per the current recall notice, the lights came on that were highlighted in the notice ( ”mil” , abs warning light) so I had my car towed into the dealership. They claimed my car had a bad battery and the problems were not due to the recall situation. I took my car out of there and straight to auto zone, about 200 feet from the dealership. My battery tested fine. Not only this, the lights (check engine, and others) were no longer illuminated and the radio was mysteriously working again. I'm not sure what they did to my car, but they charged me over $200 for a diagnosis. Not only this, they cited several other issues with the vehicle that I nor my master mechanic were aware of. They had my car for several days without so much as a phone call. In addition, while I was waiting for the keys to my car (which took 15 minutes to obtain), I overheard the other gentleman inform a kia owner via phone that her car was not covered under the warranty because she had over 150k miles on the car. I'm so disgusted. This is what happens every time we have to take a car into a dealership. They're full of baloney.
Clock spring broke causing airbag light to turn on. Clicking when turning steering wheel. Airbag will not deploy due to this issue. $800 cost of repairs.
My airbag light on and I've check the fuses in it,not it,,, my ac,. The drivers door lock , oxagen senser crank shaft,.
